3. Our Role as an Aggregator

RosCar Surin acts solely as an intermediary platform that aggregates car rental options from various rental companies. We provide a comparison and booking service but do not:

• Own, operate, or maintain rental vehicles
• Employ drivers or rental staff
• Control the availability, condition, or quality of rental vehicles
• Set rental prices (prices are determined by rental companies)
• Act as an agent for any rental company

Your rental contract is directly between you and the selected rental company. The rental company is responsible for providing the vehicle and related services.

4. Eligibility and Requirements

To use our services and rent a vehicle, you must:

• Be at least 21 years of age (age requirements may vary by rental company)
• Hold a valid driver’s license for at least one year
• Possess a valid International Driving Permit (IDP) if required
• Have a valid credit or debit card in your name
• Provide accurate and complete information during booking
• Meet any additional requirements specified by the rental company

5. Booking Process

5.1. Making a Booking

When you make a booking through our platform, you will be required to provide personal information, rental details, and payment information. You warrant that all information provided is accurate and complete.

5.2. Booking Confirmation

Upon completing a booking, you will receive a confirmation email containing your booking details and voucher. This confirmation is subject to availability and acceptance by the rental company.

5.3. Voucher

Your booking voucher must be presented to the rental company at the time of vehicle pickup, along with your driver’s license, IDP (if required), and payment card.

6. Pricing and Payment

6.1. Displayed Prices

Prices displayed on our platform are provided by rental companies and are quoted in Thai Baht (THB) or other currencies as specified. Prices may include or exclude certain fees, taxes, and insurance options as indicated in the booking details.

6.2. Payment Methods

Payment is processed according to the rental company’s policies. This may include:

• Full prepayment at the time of booking
• Deposit payment with balance due at pickup
• Full payment at the rental counter

6.3. Additional Charges

You may be subject to additional charges by the rental company for:

• Additional drivers
• Child seats or GPS devices
• Additional insurance coverage
• Fuel charges
• Late returns
• Damage or cleaning fees
• Traffic violations or fines

6.4. Currency Conversion

If paying in a currency different from the displayed price, exchange rates and conversion fees applied by your bank or payment provider may apply.

7. Cancellation and Modifications

7.1. Cancellation Policy

Cancellation terms vary by rental company and are specified in your booking confirmation. Generally, cancellation policies include:

• Free cancellation up to a certain period before pickup (typically 24-48 hours)
• Partial or full charges for late cancellations

• Valid driver’s license
• International Driving Permit (if required)
• Valid passport or ID
• Credit or debit card in the main driver’s name

8.2. Vehicle Inspection

You are responsible for inspecting the vehicle before accepting it. Report any pre-existing damage to the rental company immediately and ensure it is documented.

8.3. Return Conditions

Vehicles must be returned:

• At the agreed date and time
• To the agreed location
• In the same condition as received (normal wear and tear excepted)
• With the same fuel level as at pickup (or as specified in the rental agreement)

9. Insurance and Liability

9.1. Insurance Coverage

Insurance options vary by rental company and may include Collision Damage Waiver (CDW), Theft Protection (TP), and Third Party Liability. Review the insurance terms carefully before confirming your booking.

9.2. Your Liability

You are responsible for:

• Any damage to the rental vehicle during the rental period
• Traffic violations and fines incurred during your rental
• Loss or damage to the vehicle’s keys, documents, or accessories
• Any damage or liability not covered by the insurance

9.3. Security Deposit

The rental company may require a security deposit, which will be blocked on your credit card at pickup and released after the vehicle is returned and inspected.

10. Driving Rules and Restrictions

When renting a vehicle, you agree to:

• Comply with all Thai traffic laws and regulations
• Drive only in authorized areas (some rentals may restrict cross-border travel)
• Not sublet or allow unauthorized persons to drive the vehicle
• Not use the vehicle for illegal purposes
• Not drive under the influence of alcohol or drugs
• Not participate in races, rallies, or off-road activities unless authorized

11. Personal Data and Privacy

We collect and process your personal data in accordance with our Privacy Policy. By using our services, you consent to such processing and you warrant that all data provided by you is accurate.

12. Limitation of Liability

To the fullest extent permitted by law:

• RosCar Surin acts solely as an aggregator and is not liable for the acts or omissions of rental companies
• We do not guarantee the availability, quality, or condition of rental vehicles
• We are not responsible for any delays, cancellations, or changes made by rental companies
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of our services
• Our total liability to you shall not exceed the amount paid by you for the booking

This limitation of liability does not apply where prohibited by law.

13. Disputes with Rental Companies

Any disputes regarding vehicle condition, service quality, additional charges, or damages must be resolved directly with the rental company. While we may assist in facilitating communication, we are not a party to your rental agreement and cannot be held responsible for disputes between you and the rental company.

14. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of RosCar Surin or its content suppliers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

15. User Conduct

You agree not to:

• Use our website for any unlawful purpose
• Attempt to interfere with the proper functioning of our website
• Use any automated systems or software to extract data from our website
• Impersonate any person or entity
